These terms govern your use of the QC Cream website and our ice cream delivery and pickup service in Charlotte, North Carolina. By browsing the site, creating an account, or placing an order, you agree to this policy.

1. Who we are

QC Cream sells small-batch ice cream pints from South End, Charlotte. Pickup is at 1400 S Tryon St, Charlotte, NC 28203. Questions go to [email protected] or (704) 555-0174.

We deliver inside our published Charlotte ZIP zones during listed hours. If a ZIP is not in zone, checkout will say so before you pay.

2. Eligibility

You must be able to form a contract under North Carolina law. If you order for someone else, you confirm you are allowed to give us their delivery details.

The site is not directed at children under 13. Do not create an account for a child under 13.

3. Accounts

Guest checkout is available. An account is optional and lets you track orders, save delivery details, and keep a session on this device.

You are responsible for the username, email, and password you choose, and for activity on your account. Sign out on shared devices. We may suspend an account that we reasonably believe is abused, fraudulent, or a risk to customers or our shop.

4. Orders, menu, and price

The menu, prices, tax, delivery fee, and free-delivery threshold shown at checkout are the amounts you authorize. Flavors can sell out or change. We may refuse or cancel an order that we cannot fulfill, that is outside our zone, or that looks fraudulent.

An order is an offer to buy. We accept it when payment is confirmed and we send an order number (for example QC-4821). Until then, we may decline the order and refund any charge that went through.

5. Payment

Card payment runs through Stripe on a secure Stripe page. QC Cream does not store full card numbers on this site. Stripe’s terms apply to the payment step.

You authorize us and Stripe to charge the total shown, including delivery and North Carolina sales tax. If a charge fails, the order is not completed.

6. Delivery and pickup

Delivery windows are estimates. Same-night routes usually land in 45–90 minutes when you order by 8pm, but traffic, weather, and volume can change that. Tomorrow windows are confirmed by text when we can.

We leave pints at the address you give, packed cold. After we complete the drop, risk of loss passes to you, including porch theft or melting if the order sits out. Give accurate access notes (gate codes, unit number).

Pickup is at the South End address during shop hours. Bring your order number. If you are not there in a reasonable time, we may hold the pints frozen or treat the order as abandoned.

7. Allergens and food

Pints may contain milk, egg, soy, tree nuts, peanuts, wheat, or other allergens. Ingredients and allergen lists are on each flavor page. Our kitchen handles shared equipment, so we cannot promise a pint is free of traces.

If you have a food allergy or dietary restriction, read the flavor page before you order. QC Cream is not a substitute for medical advice. Do not eat a pint that looks or smells wrong; contact us instead.

8. Cancellations, refunds, and problems

Ice cream is perishable. We generally do not refund a correctly delivered or picked-up order because you changed your mind.

Contact [email protected] as soon as you can if the order is wrong, incomplete, badly melted on arrival, or never showed up. We may refund, replace, or credit at our discretion after we look into it. Photos help.

Chargebacks: talk to us first. If you open a dispute with your bank while we are already resolving the order, we may share delivery records with the payment provider.

9. Acceptable use

Do not scrape the site in a way that harms the shop, probe for security holes, bypass payment or ZIP checks, impersonate others, or use the service for anything illegal.

Automated abuse of checkout, login, or Cloudflare Turnstile is forbidden. We may block IPs or accounts that attack the site.

10. Intellectual property

The QC Cream name, QC mark, flavor names, photos, copy, and site design belong to QC Cream or our licensors. You may not copy the brand or menu for a competing shop.

You grant us a limited right to use the delivery notes and feedback you send so we can fulfill and improve orders.

11. Third-party services

The site uses Cloudflare Turnstile to reduce bots on login, register, and checkout. Payments use Stripe. Those companies process data under their own policies when you hit their widgets or payment page.

12. Disclaimers

The site is provided as available. We do not warrant uninterrupted access, that every flavor is in stock, or that delivery will always meet the estimate.

Except where North Carolina law does not allow it, implied warranties are limited to the shortest period the law permits. Perishable food is sold as described on the flavor page.

13. Limitation of liability

To the fullest extent North Carolina law allows, QC Cream is not liable for indirect, incidental, special, or consequential damages, including lost data on your device or porch theft after delivery.

Our total liability for an order is limited to the amount you paid for that order, except for liability that the law says we cannot limit (for example, certain personal injury from our negligence).

14. Changes

We may update these terms. The date at the top of this page is the current version. Continued use after a change means you accept the new terms for later visits and orders. Material changes to orders already placed will not apply retroactively except as the law requires.

15. Governing law

North Carolina law governs these terms, without regard to conflict-of-law rules. Courts in Mecklenburg County, North Carolina, are the venue for disputes that cannot be resolved with us directly, except where a consumer law gives you another forum.
